Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ApneaX mobile application (the "Service") operated by ApneaX ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Use of the Service

Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate ApneaX, an ApneaX employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm ApneaX or users of the Service or expose them to liability.

Health Disclaimer

ApneaX is designed as a training tool for breath-holding and respiratory exercises. The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Before starting any breath-holding or respiratory training program, you should consult with your healthcare provider to ensure it is appropriate for your individual circumstances.

You acknowledge that there are risks associated with breath-holding exercises, including but not limited to:

• Lightheadedness, dizziness, or fainting
• Hypoxic states (low oxygen levels)
• Loss of consciousness
• In rare cases, more severe health complications

By using the Service, you agree to:

• Use the app responsibly and at your own risk
• Never practice breath-holding exercises in water without proper supervision
• Always perform exercises in a safe environment where you can sit or lie down
• Stop immediately if you experience any unusual symptoms or discomfort

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ApneaX and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ApneaX.

Subscriptions and Purchases

Billing

All purchases and subscriptions in ApneaX are processed as in-app purchases through the Apple App Store. Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription plans are billed in advance on a recurring basis (monthly or annual), depending on the type of subscription plan you select.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

Refunds

Certain refund requests for subscriptions may be considered by ApneaX on a case-by-case basis and granted at the sole discretion of ApneaX. All refund requests must be made directly to Apple through the App Store, as they process all payments for our iOS app.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

Limitation of Liability

In no event shall ApneaX, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without prior notice. Any changes to the Terms will be effective immediately upon posting the updated Terms on the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to regularly review these Terms to stay informed of updates. We recommend that you check the Terms periodically for changes.
