Welcome to BPress. These Terms of Service ("Terms") govern your use of the BPress iOS application ("App", "Service", "BPress"). By downloading, installing, or using BPress, you agree to be bound by these Terms.
By accessing or using BPress, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
BPress is a blood pressure tracking application that allows users to:

The App is for informational and tracking purposes only. It should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
Never use BPress for emergency medical situations. If you are experiencing a medical emergency, call emergency services immediately.
While we strive to provide accurate tools, we do not guarantee the accuracy, completeness, or reliability of any information or data within the App. You are responsible for verifying all information with qualified healthcare professionals.
Use of BPress does not create a doctor-patient relationship between you and the App developers or any healthcare professionals.

You must be at least 13 years of age to use BPress. If you are between 13 and 18 years of age, you must have permission from a parent or guardian to use the App.
BPress and all its contents, features, and functionality (including but not limited to software, design, text, graphics, and logos) are owned by BPress and are protected by international copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use BPress for your personal, non-commercial use on your iOS devices.
You retain all rights to the health data you enter into BPress. By using the App, you grant us no rights to your personal health information.
BPress offers a free version with basic features available at no cost.
Premium features are available through in-app purchase subscriptions, including:
Subscription pricing is displayed in the App and on the App Store. Prices are subject to change with notice. Subscriptions are billed through your Apple ID and processed by Apple. Payment will be charged to your Apple ID at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial periods.
We may offer free trial periods for premium features. If you do not cancel before the trial ends, you will be charged the subscription fee. You may cancel anytime during the trial period without charge.
All payments are processed by Apple. For refund requests, please contact Apple Support directly. Refunds are subject to Apple's refund policies.
Integration with Apple HealthKit is entirely optional. You control what data is shared through iOS permissions.
We are not responsible for the accuracy of data read from or written to HealthKit. You are responsible for verifying all health data.
Use of HealthKit features is subject to Apple's terms and conditions.

If we are found liable, our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
You agree to indemnify, defend, and hold harmless BPress and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
BPress integrates with Apple services including HealthKit, StoreKit, and iCloud. These services are governed by Apple's terms and conditions.
The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites.
You may stop using BPress at any time by deleting the App from your device. If you have an active subscription, cancel it through your Apple ID to avoid future charges.
We reserve the right to suspend or terminate your access to BPress at any time, without notice, for:
Upon termination, your right to use the App ceases immediately. Data stored locally on your device will remain unless you delete it. We are not responsible for any data loss upon termination.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BPress is registered, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of BPress shall be resolved through:
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class-wide arbitration.

The App may be subject to export control laws. You agree to comply with all applicable export and import laws and regulations.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BPress regarding your use of the App and supersede all prior agreements.
