01 Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the ServSafe Prep application and related services. By downloading, installing, or using ServSafe Prep, you agree to be bound by these Terms. If you do not agree, please do not use the app.

02 License to use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use ServSafe Prep for your own exam preparation. You may not copy, distribute, reverse-engineer, or create derivative works from the app or its content except as permitted by law.

03 No account needed

ServSafe Prep does not require you to create an account or provide any personal information to use it. The app works entirely on your device, and all of your study data stays there. See our Privacy Policy for details.

04 Subscriptions & payments

ServSafe Prep offers an optional auto-renewing subscription that unlocks premium features. All payments are processed exclusively by the Apple App Store under Apple's standard subscription terms. We never receive, see, or store your payment information.

• The price, billing period, and renewal terms are shown in the App Store before you confirm any purchase.
• Your subscription renews automatically at the end of each billing period unless you turn off auto-renew at least 24 hours before it ends.
• You can manage or cancel your subscription at any time in your Apple ID account settings. Deleting the app does not cancel an active subscription.
• Payment is charged to your Apple ID at confirmation of purchase and on each renewal.
• All billing, renewals, cancellations, and refunds are handled solely by Apple in accordance with the Apple Media Services Terms. We are unable to issue refunds directly and are not responsible for Apple's billing decisions.

05 Acceptable use

You agree not to misuse ServSafe Prep. In particular, you will not:

• Use the app for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to our systems or other users' data.
• Scrape, redistribute, or resell question content without permission.
• Interfere with or disrupt the integrity or performance of the app.

06 Educational disclaimer

We make no representation, warranty, or guarantee of any kind regarding exam results, certification, licensure, or any other outcome. Passing the practice content does not predict or guarantee a passing score on any actual examination. Exam content, format, and requirements may change at any time; you are solely responsible for confirming current requirements with official sources. Your use of ServSafe Prep is entirely at your own discretion and risk.

07 Intellectual property

All content we create in ServSafe Prep — including our questions, explanations, design, logos, and software — is owned by us or our licensors and protected by intellectual property laws. "ServSafe®" is a registered trademark of the National Restaurant Association; we use it only to describe the exam our independent study material helps you prepare for, and we claim no ownership of or affiliation with it.

08 Disclaimer of warranties & limitation of liability

ServSafe Prep is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any content is complete or accurate.

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, exam results, certification, or licensure, arising out of or relating to your use of (or inability to use) ServSafe Prep, even if we have been advised of the possibility of such damages. Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid for the app, if any, in the twelve months preceding the claim.

09 Termination

We may suspend or terminate your access if you violate these Terms. You may stop using ServSafe Prep at any time by deleting the app. Provisions that by their nature should survive termination will continue to apply.
